The on-going clash in Kemah continues, with another business owner this time filing a federal lawsuit with the U.S. 5th Circuit Court of Appeals.
"The city of Kemah ordered the closure of a building housing multiple businesses, but without what we call a pre-depravation notice or hearing, and that's not legal" said Holly Hansen, reporter with The Texan.
It's just the latest lawsuit involving the coastal city, which has multiple cases currently pending.
"Kemah is also facing several other lawsuits over property rights" Hansen told KTRH, "One from the owner of a residential property, and another from a group of businesses that filed over the city's closure of Sixth Street in the entertainment district."
Again, those case are still pending. But it's become clear that the city has other plans, and are trying to get rid of the small businesses.
"It does seem as though the city has plans for the area, possibly a convention center or something along those lines" noted Hansen.
Also according to Hansen, in response to a recent open records request, Kemah officials claimed that there was no pending litigation against the city.
