An appeals court is ruling in favor of DOGE and their operations at USAID.
On Friday, a federal appeals court granted a motion from the Trump administration to extend a stay allowing the Department of Government Efficiency to continue working at the United States Agency for International Development. This comes after a federal judge in Maryland ruled that efforts to halt USAID practices were likely unconstitutional and ordered for its reinstatement.
It's the third appeals victory for the Trump administration.
A few dozen unidentified current and former USAID employees or contractors allege that the Trump administration violated the U.S. Constitution’s appointments clause because Elon Musk acted as DOGE administrator without being properly appointed. The Trump administration argued that Musk acts as a senior advisor to the president and actions at USAID were carried out by Secretary of State Marco Rubio, who is also USAID’s acting administrator.
