Trump Faces Resistance From Yet Another Obama Judge

Trump campaigned on reducing the size and scope of the federal government, but due to activist judges in federal courts, clearing out bureaucrats is proving more difficult than he anticipated. Another Obama-appointed judge has now prevented Trump from firing federal workers.

U.S. District Judge James Bredar has ordered that the layoffs are paused for two weeks, and also that the workforce is returned to the status quo before Trump ordered the layoffs.

Robert Romano, with Americans for Limited Government, says that Trump clearly has the right to fire these workers. He said, "Agencies absolutely have the right to terminate probationary employees. This is definitely judicial overreach. Trump clearly has the law on his side."

Romano pointed out that because these workers were probationary, they don’t have the same legal protections against terminations as long-term, officially appointed government employees.

He thinks Judge Bredar knows that Trump is simply following longstanding laws. He said, "These judges want to decide that the laws don’t apply when Trump is the President, and that he’s less than the President, or an illegitimate president, or something like that."

Romano does think that when it’s all said and done, Trump will come out on top of these legal battles, but it won’t happen overnight. He said, "These injunctions are just gonna keep coming, so you have to let the legal process play out."

The good news is, Trump is now setting strong precedents in these cases and clearing the way for a return to a true Article 2 presidency. Romano said, "Future presidents will thank President Trump for the actions that he’s taking."
