The Latest In The Trump NY sentencing

In the latest 'summer surprise' for former president Donald Trump who was due back in court on Thursday, Judge Juan Merchan has delayed the sentencing in Trump's NY case until September 18th.

This all stems from last weeks ruling from the U.S. Supreme Court that a former president has substantial immunity for official acts while committed in office. So what are the expectations now?

"If I'm former president Trump's camp, I am assuming he's going to get jail time" said Dallas based appellate attorney, Byron Henry, "Every delay benefits president Trump, even though this puts him in the middle of election season."

Of course, election season really ramps up after Labor Day, and Trump's new sentencing date is Tuesday, September 18th.

"The real question is, is he given jail time and is he remanded on that day, or given a date to report" Henry told KTRH, "Because what will happen if he's given a date to report, is that they'll file their notice of appeal and their motion that he remain out of jail pending appeal."

And if the motion to appeal is granted, which Henry says it should, that would push everything well beyond the election, and likely into next year.
