Travis County DA tries reversing Daniel Perry pardon for killing BLM rioter

The year 2020 was arguably the dumbest year in American history. Setting aside the ridiculous shutdowns over the COVID pandemic, we also got the death of George Floyd, and the insane protests that followed. People setting stores on fire in the name of justice and rioting in streets over what was an open and shut case to begin.

During those 2020 hissy fits thrown by millennials, the City of Austin was one of the hotbeds of unrest. They saw a massive protest that ended in death for one individual. That was Garrett Foster, a white man who decided it was a good idea to stick his rifle into the car window of former Army Sergeant Daniel Perry. Rightfully so, Perry fired his own weapon at Foster, killing him. Because Austin has taken a turn into the liberal depths, Foster was charged with murder by the Travis County DA. He was ultimately found guilty and sentenced to 25 years in prison.

But enter Governor Greg Abbott, who after sending Perry's case to the Board of Pardon and Parole, decided to invoke his constitutional right to grant a pardon. The Travis County DA has not been a fan of the move and is now pushing to overturn Abbott's pardon.

However, Conservative Attorney Michelle Maples says this is an attempt at overturning the state constitution and has virtually no chance of succeeding.

"The Travis County DA has filed this Writ of Mandamus basically saying he does not like what Abbott did, please do something different...all the people on the appeals court are Republican. This is just not going to happen," she says.

The state board of pardons recommended a full pardon of Perry as well after a near yearlong review.

But an action like this, in addition to costing taxpayers' money, sets a worrisome example.

"You better believe other Attorneys General around the county are watching this closely, and wondering if they can do something to overturn their own state constitution," she says.

The Travis County DA Jose Garza is a big Democrat, obviously, and really wants to prove he can get a win in a state of Republicans. But in this case, he is fighting a losing battle on the logic front alone. You point a weapon at someone, you have crossed a line into aggression. Foster did just that.

But this is also an election year, and Garza just so happens to be up for re-election. So, Democrat do what Democrat does: try to get a political score by any means necessary.

"These people just want to win...they couldn't care less about justice or the Texas Constitution," Maples says.

She adds that they should be more concerned about keeping their own city safe, rather than political games.
