No Third Trial for David Temple

In a Harris County courtroom Wednesday a judge ruled that convicted murderer David Temple will not get a third trial.

The former Katy football coach was found guilty for a second time in August 2019 of shooting his pregnant wife Belinda to death in January 1999, though the jury was hung on a sentence and a mistrial declared. An appeals court had reversed the guilty decision of his first trial for prosecutorial misconduct.

Prosecutors had requested a change of venue for the sentencing hearing, which was also denied by the judge.

The punishment-phase of his trial will begin in March as originally scheduled.
