DA's Office Seek Recusal in 1999 Murder Case

The Harris County District Attorney’s Office is recusing itself from the case of David Temple, the football coach found guilty in 2007 for his wife's killing but later freed from prison.

The recusal was filed in 178th District Court. A special prosecutor will likely be appointed by a judge.

Belinda Temple was shot to death in 1999 in her Katy home. 

A grand jury indicted DavidTemple in 2005; he was convicted and sentence to life in prison. Last year, however, an appeals court overturned Temple’s conviction. It agreed with a lower court ruling that prosecutors did not properly supply of offense reports that pointed to other possible suspects -- and ordered the DA's Office to re-try Temple or drop the case.
