The Texas Supreme Court has cleared the way for a new execution date for Robert Roberson, who was convicted in 2003 of killing his daughter.
A Texas State House Committee had subpoenaed Roberson's testimony, which led to the Texas Supreme Court temporarily halting the execution.
On Friday morning, the Court formally denied the committee's request to delay the execution, which clears the path for a new execution date to be set. Roberson was originally set to be executed in October.
In their ruling, the Texas Supreme Court decision stated, “Categorically prioritizing a legislative subpoena over a scheduled execution... would become a potent legal tool that could be wielded not just to obtain necessary testimony but to forestall an execution.”
