The Office of Attorney General Ken Paxton announced this morning that they have secured a major win for election integrity here in Texas. The Fifth Circuit Court of Appeals has issued a stay that will allow Texas to prevent and investigate ballot harvesting.
A key provision of the Texas election law, SB1, was struck down by a federal district court judge, but Paxton was able to secure a temporary stay of that order from the Fifth Circuit Court of Appeals on October 4th, and has now secured a full stay pending an appeal.
The Fifth Circuit said, "On the eve of elections in Texas, the district court has entered an injunction that impacts how ballots can be handled. It holds unconstitutional a law that has been on the books for over three years, but that the court did not see fit to enjoin until now."
Attorney General Ken Paxton said in his statement, "We fought hard to ensure that the Texas laws protecting the ballot box will be in full force and effect this election season.”
