Former President Donald Trump is set to file a $100 million lawsuit against the Biden Administration's DOJ, alleging that the 2022 raid on Mar-a-Lago was unconstitutional and carried out for political reasons.
According to a memo obtained by Fox News, Trump's lawyers argue that the raid was "political persecution." The raid was part of Special Counsel Jack Smith's investigation into Trump's retention of allegedly classified documents. Smith has brought 37 indictments against Trump in that now-dismissed case.
U.S. District Judge Aileen Cannon dismissed the case last month, ruling that Smith was unlawfully appointed. The DOJ also declined to indict President Joe Biden in a similar case, citing questions about his mental ability to stand trial.
The Department of Justice now has 180 days to reach a resolution with Trump's lawyer, Daniel Epstein; otherwise, the case will go to trial in federal court.
