Judge rules Texas must remove floating border wall

A federal judge has ruled against Texas and for Biden's open border policies.

Texas must remove floating border buoys by Friday, September 15th. The state cannot install any similar structures in the Rio Grande without receiving approval, a federal judge wrote today. The state will appeal.

Federal Judge David Ezra of the Western District of Texas - a Reagan appointee - wrote that the Justice Department will likely prevail in the civil suit filed against Abbott. The Justice Department argued that Texas violated a federal law against unauthorized construction in in navigable waterways.

The Governor installed the floating border wall in response to the end of Title 42. After apprehensions declined in June, they skyrocketed in July and August. The August number was around 180-thousand, not including 'gotaways.'

The Governor has responded to the ruling with a statement that Texas will appeal.

“Texas will appeal. Today’s court decision merely prolongs President Biden’s willful refusal to acknowledge that Texas is rightfully stepping up to do the job that he should have been doing all along. This ruling is incorrect and will be overturned on appeal. We will continue to utilize every strategy to secure the border, including deploying Texas National Guard soldiers and Department of Public Safety troopers and installing strategic barriers. Our battle to defend Texas’ sovereign authority to protect lives from the chaos caused by President Biden’s open border policies has only begun. Texas is prepared to take this fight all the way to the U.S. Supreme Court.”
