Lawyers in Texas are gearing up for a spike in employment-related lawsuits. Tensions are rising between some workers and their bosses.
At its core, a potential flurry of lawsuits surrounds a law Congress past two months ago. It’s called the Families First Coronavirus Response Act. It insures sick leave for employees taking care of themselves or family members with COVID-19. Employers get a tax credit. It sounds good at first, but legal expert Rob Crain says it's also creating problems.
“Some employers are not able to fund that kind of capital while they then on the backside go back to the government and ask for reimbursement, tax credits, and so forth,” Crain said.
Crain also expects to see some workplace safety complaints. His Dallas law firm has filed a wrongful death case involving an employee who allegedly contracted COVID-19 while at work.
He recommends bosses and employees communicate if they have concerns about their health or the health of a family member. He also says companies will have to make sure they take steps to ensure employees won't catch or spread the virus when they return to the office.
