A group representing Memorial City area homeowners is trying to get a lawsuit against the city of Houston reinstated.
Residents Against Flooding went before a panel of the 5th Circuit Court of Appeals this week claiming city flood control policy in the area benefits Memorial City commercial interests at the expense of residents. A judge threw out the lawsuit a year ago on the grounds that federal courts have no jurisdiction over city flood policy.
The suit was filed in 2016, prior to Harvey's floods last August.
