Investigators say the victim was at an ATM in Spotsylvania, Virginia at around 9pm on Friday night holding cash in his hand when the suspect approached in a “threatening” manner.
NBC12 reports. "the suspect hit the victim several times, before the victim, a CHL holder, pulled his gun and fired several shots at the suspect. The suspect later identified as Trey Khiry Turner, 24, was not hit. He ran off and then called 911 to report that he was being shot at."
After po-po determining that the 911 caller matched the description of the suspect at the ATM, Turner was taken into custody and charged with attempted robbery.
Po-po say the robbery victim suffered minor injuries during the incident. Turner was not injured. Court records show that Turner was previously convicted of attempted robbery and using a firearm in the commission of a felony as the result of a July 10, 2016, incident in Spotsylvania.
He was ordered to serve three years in prison as the result of those convictions.
