Harris County DA To Push For Death Penalty In Nungaray Case

Harris County District Attorney Kim Ogg announced this morning that she has made a decision on the punishment for the two illegal aliens charged with killing 12-year-old Jocelyn Nungaray from Houston earlier this year.

She told "Fox and Friends" this morning that, "We'll be filing notice by the State of Texas, that we intend to seek the death penalty against Jocelyn's murderers, Peña and Rangel."

When the two suspects were first arrested for Nungaray's murder, they weren't eligible for the death penalty under Texas law, but as the investigation continued, evidence that they had sexually assaulted Jocelyn was discovered, which qualifies them for capital punishment.

Ogg went on to tell "Fox and Friends" that this was not a choice made lightly. She said, "We base these decisions on the strength of the evidence, and the gruesomeness of this crime. And yes, I've spoken with Alexis Nungaray multiple times, along with her father. Their family is supportive of this move."

Of course, bringing the charges is only half the battle, but Ogg is confident that she can secure a conviction. She said, "We feel that a Texas jury will sentence these two defendants, based on the evidence that we have, to death. So we are giving notice to the defense and the court that that is our intention."
