Update: Texas Supreme Court Halts Execution

Update: After an appeals panel overturned the Travis County judge's ruling last night, the all republican Texas Supreme Court, stepped in at the last minute to stop the execution. Roberson is set to still testify Monday.

A Travis County judge has granted a temporary restraining order from Texas lawmakers that will temporarily pause the execution of Robert Roberson.

Roberson was set to be put to death by lethal injection on Thursday at 6 p.m. for the 2002 death of his daughter, Nikki. It would be the first time in American history that someone has been put to death for a case involving 'Shaken Baby Syndrome.'

The Texas Legislature argued that they have the right to determine whether certain state laws are working. In this case, in order to figure out if the junk science law was working, they needed Roberson to testify at a hearing next Monday.

Vanessa Potkin with The Innocence Project says Roberson is not guilty.

"She was very sick. This was not a murder; there was no crime here," Potkin told KTRH News.
