Texas AG Ken Paxton sues Biden's HHS over law that weakens investigations

Another day, another lawsuit launched by Texas Attorney General Ken Paxton.

In his second suit of Wednesday, Paxton sued the Biden Administration's Department of Health and Human Services (HHS), including its secretary Xavier Becerra, to stop a new law that would 'unlawfully restrict state law enforcement investigations.'

The law, which was put into effect after the Supreme Court overruled Roe v. Wade and returned abortion power to the states. It would limit state law enforcement investigations that implicate medical procedures. It basically allows them to go around the Courts, which have already said States can investigate such cases, including those dealing with abortion, which has been outlawed in Texas.

It also violated the Health Insurance Portability and Accountability Act (HIPPA), which explicitly gives states power to investigate. Paxton's suit orders to vacate the rule and prevent HHS from enforcing these laws.

Paxton said in a release:

“This new rule actively undermines Congress’s clear statutory meaning when HIPAA was passed, and it reflects the Biden Administration’s disrespect for the law,” said Attorney General Paxton. “The federal government is attempting to undermine Texas’s law enforcement capabilities, and I will not allow this to happen.”
