Court: Medication Abortions Not Covered By TX Elective Procedure Ban

Certain abortions will be allowed in Texas during the coronavirus pandemic. The Fifth Circuit Court of Appeals ruled Tuesday they have plenty of doubts regarding Texas' claim that medication abortions are a medical procedure.

Planned Parenthood argued they could not be considered a procedure because it involved dispensing medication. Justices did not make a decision on other abortion procedures.

Texas Attorney General Ken Paxton said abortion was covered under Governor Greg Abbott's executive order banning elective medical procedures.

Planned Parenthood sued over the issue. Acting President Alexis McGill Johnson is calling it a partial victory but vowed the fight was not over.
